Some organisation information may not constitute personal information where it relates solely to a corporate entity. It may nevertheless be personal information where it identifies a sole trader, partner, company officer, employee or other individual.

Publication licence-request information

This may include:

• the publication and licence requested;

• the named purchaser;

• the named licensed user;

• the licensed user’s professional email address;

• the preferred payment method;

• business-use and price confirmations;

• acceptance of the Terms of Use and Sale and Publication Licence; and

• information supplied in support of a licence request.

Assetreal does not intentionally request special-category personal information through the website or licence-request form. Individuals should not provide sensitive personal information unless it is necessary and Assetreal has agreed to receive it.

Assetreal does not receive or retain complete payment-card details. Card information is entered directly into the systems of the payment provider identified in the relevant payment instructions. Bank-transfer information may be processed by Assetreal’s bank or by another bank, payment provider or electronic-money institution identified in the invoice or payment instructions.

4. How we obtain information

We obtain personal information:

• directly from individuals who complete a form, submit a licence request, make or arrange payment, communicate with Assetreal or exercise their rights;

• from organisations where an individual acts as their representative, employee or named licensed user;

• automatically through the website and necessary technical systems;

• providers of website-hosting, form, payment, banking, electronic-money, email, storage, download, access-control and security services involved in operating the website, processing payments or delivering a publication; and

• from publicly available corporate and professional sources where reasonably necessary to assess a professional enquiry or verify a prospective purchaser.

Public sources may include:

• an organisation’s own website;

• official company registers;

• official VAT or tax-registration services;

• professional directories;

• regulatory registers; and

• publicly available professional profiles.

Assetreal will seek to collect only the information reasonably necessary for the stated purpose.

5. How and why we use information

• prepare proposals, engagement terms and fee quotations;

• prevent fraud, misuse, unauthorised purchasing and security incidents;

• enforce the Terms of Use and Sale and Publication Licence;

Submitting a licence request does not automatically result in its acceptance. Assetreal may review the information manually and may decline a request or seek further information.

6. Lawful bases

Depending on the circumstances, Assetreal may rely on the following lawful bases.

Contract

Assetreal may process information where necessary:

• to take steps requested by an individual before entering into a contract; or

• to perform a publication purchase, publication licence, commissioned research or advisory contract to which that individual is a party.

This may include responding to a request for a quotation or proposed engagement, agreeing scope and terms, issuing payment instructions or invoices, supplying publications, providing commissioned research or advisory deliverables, and administering the relevant contract.

Legitimate interests

Assetreal may rely on its legitimate interests where appropriate. These interests include:

• responding to professional and commercial requests;

• assessing and responding to commissioned research and advisory enquiries;

• preparing, negotiating and administering research and advisory engagements with organisations and their representatives;

• communicating with client and prospective-client personnel concerning scope, information supplied, deliverables, invoicing and engagement administration;

• maintaining appropriate client, engagement and business records;

• verifying prospective purchaser and organisation details;

• determining whether a request appears to be business-to-business;

• operating and securing the website;

• maintaining appropriate business, payment, delivery, access and licence records;

• preventing fraud and misuse;

• administering publications;

• investigating disputes;

• protecting intellectual-property rights; and

• establishing, exercising or defending legal claims.

Where Assetreal relies on legitimate interests, it considers whether the processing is necessary and whether the individual’s interests, rights or freedoms override those interests.

7. Publication licence requests and purchaser verification

Information submitted through the Publication Licence Request form is used to:

• identify the publication and licence requested;

• identify the prospective purchaser and named licensed user;

• confirm professional and organisation details;

• assess whether the request appears to be for business or professional use;

• prepare appropriate payment instructions; and

• maintain a record of the request and confirmations supplied.

Assetreal may compare information supplied in the form with publicly available corporate, professional, tax-registration or regulatory sources.

These checks are proportionate commercial checks and are not intended to constitute an investigation of the requester’s personal affairs.

Where information appears incomplete, inconsistent or unreliable, Assetreal may:

• ask for clarification;

• request further business evidence;

• decline to issue payment instructions; or

• decline the licence request.

Submitting a request does not create a professional-services relationship and does not oblige Assetreal to accept an order.

8. Orders, payment and publication delivery

Where a licence request is accepted, Assetreal may send:

• a customer-specific secure card-payment link; or

• an invoice containing bank-transfer instructions.

Card payments may be processed by the payment provider identified in the relevant payment instructions. Bank transfers may be processed through Assetreal’s bank or through another bank, payment provider or electronic-money institution identified in the invoice or payment instructions.

Those providers may collect and process payment, billing, fraud-prevention, transaction and identity information under their own terms and privacy notices.

Assetreal may receive information such as:

• payer name;

• billing details;

• payment status;

• payment reference;

• payment method;

• transaction currency;

• limited payment information needed to reconcile the transaction; and

• fraud, chargeback or dispute information where relevant.

Assetreal does not directly receive or retain complete payment-card numbers or security codes.

Following cleared payment, the publication may be personalised with information including:

• the named licensed user;

• organisation name;

• licence type;

• invoice or order reference;

• delivery date; and

• licence or copyright notices.

The publication may be supplied by secure electronic download, sent directly by email, or provided through another appropriate electronic delivery method. Assetreal may send the PDF, a download link, access instructions or related service communications to the professional email address supplied for the named licensed user.

Assetreal may retain records showing when the PDF, download link or access instructions were created, sent, made available, accessed, downloaded, reissued, extended or replaced. These records are used to administer the contract, support the licensed user, protect intellectual-property rights, maintain security and respond to disputes.

9. Marketing communications

Submitting a professional enquiry, commissioned research or advisory enquiry, or publication licence request does not by itself subscribe the individual to a marketing list.

Assetreal may use the professional email address supplied to communicate about:

  • the enquiry and any follow-up questions;

  • a proposed or active commissioned research or advisory engagement;

  • scope, terms, quotations and information required for an engagement;

  • deliverables, invoices, payments and engagement administration;

  • a publication licence request, order, payment, delivery, download or access;

  • licence administration; and

  • necessary service, contractual or legal information.

These communications are principally administrative or service-related and are not intended to subscribe the recipient to general promotional communications.

Where Assetreal sends separate direct-marketing communications, it will do so only where permitted by applicable data-protection and electronic-marketing law. Recipients will be given an appropriate means to object or opt out, and Assetreal will respect such requests.

Where consent is required for a particular form of marketing, consent may be withheld or withdrawn without affecting a professional enquiry, commissioned research or advisory engagement, publication licence request or purchase.

10. Cookies and website information

The website uses cookies and similar technologies that are necessary for:

• website functionality;

• form operation;

• security;

• fraud prevention;

• accessibility;

• payment, download or access functionality where applicable; and

• the storage of visitor preferences.

Assetreal does not sell personal information.

12. International transfers

Some service providers may process personal information outside the United Kingdom.

Where a restricted international transfer occurs, Assetreal will rely on:

• appropriate contractual or organisational safeguards; or

• another transfer mechanism permitted by data-protection law.

13. Retention

Assetreal retains personal information only for as long as reasonably necessary for the purposes described in this notice and to meet legal, accounting, taxation, contractual, licensing, fraud-prevention and dispute-resolution requirements.

Normally:

• professional enquiries that do not lead to an engagement or purchase are retained for up to 24 months after the last meaningful communication;

• licence requests that do not result in a purchase are retained for up to 24 months after the request or last meaningful communication;

• records relating to commissioned research or advisory engagements, including proposals, agreed scope, engagement terms, key correspondence, deliverable records and related administrative information, are normally retained for up to six years after completion or termination of the engagement where reasonably necessary for contractual, accounting, taxation, dispute-resolution or legal purposes;

• client-supplied information and working materials used principally to perform a commissioned research or advisory engagement are retained only for as long as reasonably necessary for the engagement, any agreed post-engagement support and applicable contractual or legal requirements, after which they may be deleted, anonymised or securely disposed of;

• information may be retained longer where a request raises concerns about fraud, misuse, sanctions or legal compliance;

• order, invoice, payment-status, purchaser-verification, licence, personalised-publication, download, access and delivery records are normally retained for at least six years from the end of the relevant financial year;

• correspondence relating to an active order, licence, dispute, infringement or legal claim is retained until the matter is concluded and for an appropriate limitation period afterwards;

• cookie and technical information is retained for the period stated in the relevant service or cookie settings; and

• data-protection request and complaint records are retained for as long as reasonably necessary to demonstrate that the matter was handled appropriately.

UK data-protection law does not prescribe one universal retention period. Organisations must justify their retention periods and avoid retaining identifiable information longer than necessary. VAT-related business records generally need to be retained for six years.

Information may be deleted earlier where it is no longer required or retained longer where necessary for legal proceedings, regulatory requirements, fraud prevention or the protection of legal rights.

14. Security

Assetreal uses reasonable organisational and technical measures intended to protect personal information against:

• unauthorised access;

• alteration;

• disclosure;

• loss;

• destruction; and

• misuse.

These measures may include controls relating to purchaser verification, payment communications, personalised files, download links, access instructions, delivery records and service-provider access.

No internet transmission, email system, payment system, download service or electronic storage system can be guaranteed to be completely secure.

Depending on the circumstances, individuals may have the right to:

• request correction of inaccurate or incomplete information;

• request deletion of information;

• request restriction of processing;

• object to processing based on legitimate interests;

Publication licence requests are subject to human review.
